These Terms and Conditions govern the sale of products through www.beachunderthemoon.co.uk operated by Beach under the Moon, a sole trader business owned by Madeline Fox. By using the Website and placing an order, you agree to be bound by these Terms and Conditions.

We sell jewellery, gifts, accessories and related products through our website.

3. ORDERS
All orders are subject to acceptance and availability.
After placing an order, you will receive an order confirmation email. This email acknowledges receipt of your order but does not constitute acceptance.
A contract is formed only when we dispatch your order and send a dispatch confirmation.
We reserve the right to refuse or cancel any order for reasons including but not limited to:

4. PRICES
All prices displayed on our website are in Pounds Sterling (£).
Prices include VAT where applicable unless otherwise stated.

Payment must be made in full before goods are dispatched.
We accept payment methods displayed on our website.
By submitting payment details, you confirm that you are authorised to use the payment method provided.
6. DELIVERY
Delivery times are estimates only and are not guaranteed.
We are not liable for delays caused by:
● Postal or courier services;
● Customs procedures;
● Adverse weather conditions;

Risk in the goods passes to you upon delivery.
Ownership of the goods remains with us until full payment has been received.
7. PERSONALISED AND CUSTOM-MADE PRODUCTS
Personalised, engraved, customised or made-to-order products cannot normally be cancelled, returned or refunded unless:
● The item is faulty;
● The item is damaged;
● We have made an error in fulfilling your order.
Customers are responsible for ensuring all personalisation details provided are accurate.
8. YOUR RIGHT TO CANCEL
For non-personalised products, consumers have the right to cancel their order within 14 days of receiving the goods in accordance with the Consumer Contracts Regulations 2013.
To exercise your right to cancel, you must notify us in writing by email or post before the cancellation period expires.
Returned items must be:
● Unused;
● In their original condition;
● Returned with original packaging where possible.
You are responsible for return postage costs unless the item is faulty or incorrectly supplied.
9. REFUNDS
Approved refunds will be processed within 14 days of receiving the returned goods or proof of return.
Refunds will be made using the original payment method.
Original delivery charges will be refunded where required by law.
10. FAULTY OR DAMAGED GOODS
Under the Consumer Rights Act 2015, customers are entitled to remedies where goods are faulty, not as described, or not of satisfactory quality.
If you receive a faulty or damaged item, please contact us as soon as possible with details and photographic evidence where appropriate.

11. JEWELLERY CARE
Customers are responsible for following any care instructions supplied with products.
Normal wear and tear, accidental damage, misuse, improper storage, exposure to chemicals, or failure to follow care instructions are not considered manufacturing defects.
12. GIFT CARDS AND VOUCHERS
Gift cards and vouchers:
● Are non-refundable unless required by law;
● Cannot be exchanged for cash;
● Must be used before any stated expiry date.
We reserve the right to refuse expired vouchers.
13. INTELLECTUAL PROPERTY
All website content, including images, logos, product designs, text and graphics, is owned by or licensed to us.
No content may be copied, reproduced, distributed or used without our prior written permission.
14. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for:

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
